The state high court in Calabar, penultimate week dismissed ABENG'S no case submission filed by his lawyers in December, 2020.


The former National President of CRUTECH Alumni Association had filed a motion challenging the jurisdiction of the court as well as the tenure of office of four (4) Chapter Chairmen.


Abeng's Lawyer had contended that the tenure of Odaji John (Abuja), Ucheche Gabriel (Lagos), Ben Ndifreke( Akwa-ibom) and Michael Ushie (Cross River) had lapse, hence they were no longer qualified to challenge his elongated tenure nor present the matter before a court of competent jusrisdiction for interpretation.


However, delivering a ruling on the matter the judge held that all the aforementioned Chairmen were validly elected and whose tenures subsist.


The court refused to strike out the names of Ushie, Odaji, Ucheche and Ndifreke Ben.


The judge further stated that the defendant's arqument to the effect that the court had no jusrisdiction is baseless and dismissed. The  “no case, no jusrisdiction submission" is hereby discountenanced and refused.


With this, the judge adjourned the matter to April 13, 2021 for pre-trial.
